FIGHT CORPS RELEASE AND WAIVER OF LIABILITY AND INDEMNITY
Photography/Video release
Participants involved in any activities offered by Fight Club Fight Cape Coral, LLC d/b/a Fight Corps may be photographed or videotaped during training. The undersigned herby consents to the use of these photographs and/or videos without compensation, on Fight Corps website or in any editorial, promotional or advertising material produced and/or published by Fight Corps Fitness.
Waiver and Release of Liability
EXPRESS ASSUMPTION OF RISK
I, the undersigned, am aware that there are significant risks involved in all aspects of physical training. These risks include, but are not limited to: falls which can result in serious injury or death; injury or death due to negligence on the part of myself, my training partner, or other people around me; injury or death due to improper use or failure of equipment; strains and sprains. I am aware that any of these above mentioned risks may result in serious injury or death to myself and/or my partner(s).
I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury and/or death that may result from participation in any activity or class while at, or under direction of Fight Corps.
I acknowledge that I have no physical impairments, injuries, or illnesses that will endanger myself or others.
RELEASE
In consideration of participant and/or participants minor children being permitted to enter Fight Corps facility for any purpose including, but not limited to, observation, use of facilities, services or equipment, or participation in anyway, participant agrees to the following:
In consideration of the above mentioned risks and hazards and in consideration of that fact I am willingly and voluntarily participating in the activities offered by Fight Corps, I, the undersigned hereby release Fight Corps, their principals, agents, employees, and volunteers from any and all liability, claims, demand, actions or rights of action, which are related to, arise out of, or are in any way connected with my participation in this activity, including those allegedly attributed to the negligent acts or omissions of the above mentioned parties. This agreement shall be binding upon me, my successors, representatives, heir, executors, assigns, or transferees. If any portion of this agreement is held invalid. I agree that the remainder of the agreement shall remain in full legal force and effect.
I, the undersigned, shall not hold Fight Corps liable for any loss or stolen property left in lockers, bathrooms, showers or any other area of Fight Corps facility.
If I am signing on behalf of a minor child, I also give full permission for any person connected with Fight Corps to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and/or surgical care for the child and to transport the child to a medical facility deemed necessary for the well being of the child.
INDEMNIFICATION
The participant recognizes that there is risk involved in the types of activities offered by Fight Corps. Therefore the participant accepts financial responsibility for any injury that the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above mentioned parties, or anyone acting on their behalf, be required to incur attorney's fees and cost to enforce this agreement, I agree to reimburse the for such fees and cost. I further agree to indemnify and hold Fight Club Fitness Cape Coral, LLC, their principals, agents, employees, and volunteers from liability for the injury and/or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by Fight Corps, at the main building or abroad. This includes but is not limited to parks, recreational areas, playgrounds, areas adjacent to main building, and/or any area selected for training by Fight Corps.
Dress Code Policy:
Our only dress requirements are athletic shorts/pants, athletic shirt/sports-bra and enclosed training footwear. Fight Corps recommends no jewelry, such as, rings, necklaces, bracelets or any other accessory which may cause injury or risk of injury to you or others around you. We reserve the right to refuse you entrance into the studio if you are not properly attired.
Age Policy:
Ages 10-14 Must be accompanied by a parent or legal guardian in the workout at all times. Ages 15-17 are permitted to workout without parental supervision or accompaniment. 18 and above are considered adults and fully responsible for themselves. Fight Corps reserve the right to refuse you entrance into the studio if you are not properly attired.
Membership Policy:
I, the participant understands, Fight Corps monthly recurring membership has no cancellation fee. However, I must provide a minimum of a FIVE day notice prior to my monthly membership charge date. I also understand, no refund will be given if I fail to comply.
I, the Participant understands, freeze requests require a FIVE day notice and are for a minimum of one month and maximum of three months per year. Automatic billing will resume on my account at the end of the freeze. If I cancel my membership during the freeze, it will be subject to the FIVE day cancellation policy. My membership will need to be removed from freeze before membership can be cancelled and appropriate forms filled out. NO REFUNDS of membership will be given if I fail to make my billing change less than FIVE days prior to monthly charge date. There are no fees to place my account on hold.
Fight Corps is a private members club and the management reserve the right to refuse membership and/or entry to any individual without cause.
I have read and understood the foregoing assumption of risk, and release of liability and I understand that by signing it obligates me to indemnify the parties named for any injury or death of any person and damage to property caused by my negligent or intentional act of omission. I understand by signing this form I am waiving valuable legal rights.
